Changing a PIC listing date

Can I adjourn a PIC conference, hearing or medical assessment?

You can request a change, but an adjournment is not automatic

Contact the Personal Injury Commission immediately, explain why attendance is not possible, provide supporting evidence and copy the other parties. Keep preparing unless the Commission confirms a new date. A conference or hearing request is dealt with under the Commission’s control of procedure and existing directions. A medical assessment is different: PIC6 says a person unable to attend must notify the President before the examination date, and repeated failure to attend without reasonable excuse may result in dismissal. A scheduling inconvenience, missing evidence and medical inability should be explained differently.

The word “adjournment” is often used for any date change, but the PIC may reschedule, vary a direction, change the venue, defer allocation or refuse the request. The correct outcome depends on the type of event, urgency, reason, prior changes, prejudice and whether another arrangement would allow the matter to proceed.

Do not simply fail to log in, miss the appointment or rely on an email sent only to the insurer. Until the Commission changes the listing, the original notice remains operative. If the request is urgent, use the Pathway Portal or Registry channel identified in the notice and follow up to confirm receipt.

What supports a conference or hearing adjournment?

Identify the listing, date, case number and event type. Explain the specific obstacle: hospital admission, acute illness, unavoidable conflicting proceeding, interpreter problem, late essential evidence or inability to obtain instructions. Provide a certificate, booking record, affidavit or other document that supports the reason without disclosing unnecessary private information.

State when the problem arose, when the request was made, earlier adjournments, the other party’s position and dates of availability. Explain why video, telephone, a shorter conference, written submissions or attendance by a representative would not solve the problem. This lets the Commission assess fairness and delay rather than guess.

PIC1 expects parties to be prepared and available for listings. PIC10 permits in-person, audio-visual, audio or combined hearings, with the Commission choosing the appropriate venue. Sometimes a venue change is a more proportionate solution than postponement.

How is a medical assessment request different?

A medical assessment may involve a clinical examination that cannot simply proceed through a lawyer. PIC6 paragraph 59 requires a person who cannot attend for any reason to notify the President before the examination date. Give the medical or practical reason, expected duration and realistic availability. Do not contact the Medical Assessor directly.

PIC6 states that failure to attend on two occasions without reasonable excuse may result in dismissal under section 54(a) of the PIC Act. That is not an automatic result after one genuine emergency, but it shows why early notice and evidence matter. The Commission may also need to consider assessor availability and whether a paper assessment or another method is appropriate under Rule 108.

If travel, language, disability or support arrangements cause the problem, ask for the specific accommodation rather than assuming the assessment must be adjourned. The Commission can arrange an interpreter and can determine the assessment method. A support person requires the rules described in PIC6.

What should happen after the request is sent?

Keep monitoring Pathway and email. Unless a new direction or listing notice is issued, continue to prepare and attend if able. Tell medical providers, witnesses and representatives only after the Commission confirms the change. An insurer’s agreement does not itself alter a Commission listing.

If the request is refused, consider the available alternative: attend by the selected electronic method, narrow the event, arrange a substitute representative, make the evidence application separately or ask for reasonable accessibility assistance. Comply respectfully and preserve any objection in writing.

If the event was missed before the request could be made, contact the Registry immediately with the explanation and evidence, ask what order or notice was made in the absence and request appropriate directions. Do not wait for a dismissal notice.

    Address video, telephone, changed hours, interpreter, accessibility support and available dates.

  5. Wait for confirmation

    Continue preparing and treat the original listing as current until formally changed.

  • PIC case number and complete listing notice.
  • A concise chronology of when the problem arose.
  • Medical certificate, hospital record or other supporting document.
  • Other fixed listing or unavoidable booking evidence where relevant.
  • The other party’s position, if known.
  • Alternative dates and attendance methods.
  • Interpreter, disability or technology requirements.
  • Proof the request was sent through the correct channel.

Common adjournment mistakes

  • Do not assume asking for an adjournment cancels the listing.
  • Do not contact the Member or Medical Assessor directly.
  • Do not describe a vague inconvenience when the real problem can be documented.
  • Do not omit prior adjournments or the other party from correspondence.
  • Do not use adjournment to bypass additional-document rules or a statutory deadline.

Timing

Notify the Commission as soon as the problem is known

There is no safe generic number of days for every listing change.

  • For a medical assessment, notify the President before the examination date if unable to attend.
  • For conferences and hearings, apply immediately and comply with the individual notice or direction.
  • A request does not suspend the listing unless the Commission confirms a change.
  • If the event is missed unexpectedly, contact the Registry and other parties without delay.

Frequently asked questions

Will a doctor’s certificate guarantee an adjournment?
No. It is evidence, but the Commission decides the request and may consider another attendance method or arrangement.
Can the insurer agree to move the PIC date?
The insurer’s position may assist, but the Commission controls its listing and must issue the change.
Can I ask for video instead of postponement?
Yes. Explain why the alternative venue is workable. PIC10 allows several venue options, but the Commission decides.
What if the new report is not ready?
Explain its relevance, expected date and earlier attempts to obtain it. The Commission may refuse delay or direct an additional-documents process.
Can I call the Medical Assessor’s rooms?
Communications should go through the Commission. PIC6 generally prohibits direct party communication with the assessor outside the claimant’s examination.
What if I already missed the appointment?
Contact the Registry immediately, explain with evidence and ask what procedural step is required. Do not wait for the matter to be dismissed.
